General Terms and Conditions for the conference
issued by Engineering Leaders Community s.r.o., with its registered office at Varšavská 715/36, Vinohrady, 120 00 Prague 2, Czech Republic, ID No.: 21848343, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. C 407414, represented by Mgr. Marián Kamenišťák, executive director (hereinafter referred to as the „Organiser” or “us”).
TERMS AND DEFINITIONS
Unless otherwise specified herein or the context clearly indicates otherwise, capitalized terms in these Terms are used in the singular and plural in the following senses:
Agreement
a contractual relationship, a purchase contract, concluded between the Participant and the Organiser by purchasing a ticket to the Conference;
Civil Code
Act No. 89/2012 Coll., Civil Code, as amended;
Conference
a professional and social event dedicated to the networking and education of leading software professionals in the CEE region through lectures and hands-on workshops;
Order
závazné přijetí nabídky Organizátora na uzavření smlouvy o koupi vstupenek na Konferenci, učiněné Účastníkem prostřednictvím Webových stránek Organizátora;
Order
binding acceptance of the Organiser's offer to conclude the Agreement, made by the Participant via the Organiser's Website;
Participant
a person interested in purchasing tickets to the Conference who has concluded the Agreement with the Organiser on the basis of an Order;
Purchase Price
a collective term for the financial consideration due to the Organiser for a ticket purchased for the Conference;
Website
Organiser's website, available at www.engineeringleaders.io.
INTRODUCTORY PROVISIONS
Who is the Conference for? The Conference is not intended for consumers, but for entrepreneurs or self-employed persons or public authorities. Given the nature of the event, the Participant is considered a professional and not a consumer within the meaning of Section 419 of the Civil Code.
Participant's Declaration. The Participant declares that the Order for the Conference is made by or on behalf of the Participant as a person in the exercise of an independent profession, or as a business or public authority, solely for the purposes of such activity. Therefore, the consumer protection provisions, in particular Sections 1810 et seq. of the Civil Code, shall not apply to the contractual relationship under these Terms.
Correctness and completeness of data. The Participant undertakes to provide correct and complete information about his/her person in the Order.
ORDERING TICKETS FOR THE CONFERENCE
Proposal for the conclusion of the Agreement. The Organiser submits, via its Website, an offer to conclude the Agreement for the purchase of tickets to the Conference.
Submitting the Order. The Participant accepts the Organiser's proposal by submitting the Order via the Website by clicking on the "Complete Order" button.
Application of the Terms. By submitting an Order, the Participant agrees with the Terms. If the Participant and the Organiser agree on any terms and conditions differently, such different terms and conditions shall become part of the Agreement and shall prevail over the Terms.
What is included in the ticket. The purchased ticket provides access to networking and professional development, full access to all sessions, interactive experience zones and delicious food and refreshments throughout the day. In addition, there will be the convenience of a children's corner for families and an exclusive after party to relax and network.
The time of conclusion of the Agreement and its effectiveness. By submitting the Order, the Agreement is concluded in accordance with the Terms. The Agreement is effective upon payment of the Purchase Price.
Purchase Price. The Participant shall pay the Organizer the Purchase Price for the purchased tickets in the amount according to the type of ticket.
Dispatch of tickets. After payment of the Purchase Price, the ordered tickets for the Conference will be sent to the Participant's email address specified in the Order.
Tickets are tied to a specific person. The ticket is bound to a specific person specified by the Participant in the Order. If the Participant is unable to attend the Conference for any reason, the Participant shall not be entitled to a refund of the Purchase Price paid.
Programme changes. For the avoidance of doubt, the Organiser does not guarantee the Conference programme, which is subject to change, nor any speakers or other parameters. The Organiser reserves the right to modify the parameters of the Conference without any obligation to inform the Participant.
Withdrawal from the Agreement. The Organiser is entitled to withdraw from the Agreement if the Order was placed after the capacity of the Conference has already been fully filled, i.e. the number of tickets to be sold has already been exhausted. In such case, the Organiser shall send the Participant the cancellation to the e-mail specified in the Order and shall refund the Purchase Price without undue delay, if it has already been paid.
PAYMENT CONDITIONS
Purchase Price. The Purchase Price is exclusive of VAT, which is charged by the Organiser at the legal rate, the amount of VAT charged may change depending on changes in Czech legislation.
Payment of the Purchase Price. The Purchase Price can be paid online via the Stripe platform or we may issue an invoice to the Participant.
Timely payment of the Purchase Price. Payment of the Purchase Price is made on time if the full amount is credited to the Organiser's account on the due date.
Tax receipt and confirmation of successful ticket purchase. Upon payment of the Purchase Price, a tax receipt for the purchased tickets to the Conference will be sent to the Participant at the email address specified in the Order.
Conference Cancellation. In the event of cancellation of the Conference, the Participant shall be entitled to a full refund of the Purchase Price paid, but this shall not apply if an alternative date for the Conference is determined.
DEFECTIVE PERFORMANCE
Rights from defective performance. Rights arising from defective performance are governed by the relevant generally binding regulations (in particular Sections 1914 to 1925 of the Civil Code).
Definition of defective performance. In particular, a change in the programme, a change in the date of the Conference and/or a change in the venue of the Conference shall not constitute a defective performance by the Organiser. The Organiser reserves the right to make such changes for serious organisational and operational reasons (in particular, but not exclusively, in the event of force majeure and/or for reasons beyond the Organiser's control). The Participant will be informed without undue delay of any change in the programme, date or venue of the Conference at the email address provided in the Order.
PROTECTION OF PERSONAL DATA
Privacy Policy. Participants entrust us with their personal data. How we handle personal data can be found in the Privacy Policy.
FORCE MAJEURE
Conditions for the application of Force Majeure. We shall not be liable for any breach of our obligations under these Terms caused by Force Majeure unless otherwise provided in these Terms.
What is Force Majeure? Force Majeure means any impediment which has arisen independently of our will and which prevents us from performing our obligation if it is not reasonably foreseeable that we could have averted or overcome the impediment or its consequences and, further, that we would have foreseen the impediment at the time the obligation arose. Force majeure includes pandemics, including COVID-19, and any measures taken by the competent authorities in connection therewith.
FINAL PROVISIONS
Governing law. The contractual relationship under these Terms is governed by the law of the Czech Republic, in particular the Civil Code, excluding the rules of private international law.
Amicable dispute resolution, jurisdiction. We will always try to resolve any dispute arising between us amicably. If it is not possible to reach an amicable solution, then the courts will take their turn. We agree that any disputes arising out of the contractual relationship under these Terms shall be resolved by the court of subject matter and local jurisdiction of the Organizer's registered office.
Changes to the Terms. These Terms may be unilaterally amended or cancelled in writing by the Organiser.
Validity and Effectiveness. These Terms shall come into force and effect on 12 December 2024.
